Release of Liability & Assumption of Risk
In consideration of being permitted to rent equipment from Valley Shore Services ("the Company"), I, the undersigned, acknowledge and agree to the following:
- Assumption of Risk. I understand that kayaking, stand-up paddleboarding, and other water activities involve inherent risks including, but not limited to, capsizing, drowning, collision, adverse weather, and physical injury. I voluntarily accept all such risks.
- Release of Liability. I, on behalf of myself, my heirs, personal representatives, and assigns, hereby release, discharge, and hold harmless Valley Shore Services, its owners, employees, agents, and representatives from any and all claims, demands, losses, damages, or liability arising from my use of rented equipment, including claims based on negligence.
- Physical Condition. I confirm that I am in adequate physical health to participate in water activities and am not under the influence of alcohol or drugs.
- Swimming Ability. I confirm that I (and any persons in my party) can swim or will remain within the limits of my ability and equipment at all times.
- Equipment Responsibility. I accept full financial responsibility for any damage to, loss of, or theft of rented equipment beyond normal wear and tear during my rental period.
- Minors. If any person under the age of 19 is included in this rental, I confirm that I am their parent or legal guardian and accept liability on their behalf.
- Governing Law. This agreement is governed by the laws of the Province of British Columbia, Canada.
Rental Terms
Damage & Loss: Renter is responsible for the full replacement or repair cost of any equipment lost or damaged beyond normal wear.
Late Returns: Equipment returned after the agreed end time will be charged at the applicable hourly rate. Please call 250-486-3031 to extend.
Cancellations: Cancellations 48+ hours in advance receive a full refund or credit. Cancellations within 48 hours may be subject to a 50% fee.
Weather: The Company reserves the right to cancel or reschedule rentals due to unsafe weather conditions.
Payment: Payment is due at or before delivery. We accept cash, e-Transfer (250-486-3031), Visa, Mastercard, Apple Pay, and Google Pay.
